Introduction

Homeshare schemes must give consideration to a number of pieces of legislation.

These include:

  • Health and Social Care Act 2014
  • Disclosure and Barring Service Checks
  • Mental Capacity Act 2007
  • Housing Act
  • Employment and volunteering legislation
  • Tax and Benefits legislation
  • Health and Safety
  • Safeguarding
  • Data protection.

For this element of good practice you will need to demonstrate:

  • That you understand current legislation and how it relates to staff and Homeshare participants
  • That you understand the basic principles of safeguarding, who you need to safeguard and develop practice and process to reflect this
  • Consideration is given to what information you collect, how you store information and who you share information with
  • That any potential risks are identified and regularly reviewed.
